Boies Schiller Beats Fashion Model’s Malpractice Suit

A model who hired Boies, Schiller & Flexner to pursue individual claims against modeling agencies failed to show that the firm committed malpractice by subordinating her interests to those of plaintiffs the firm represented in more lucrative class actions, a state appellate court held last month in a little-noticed decision.

The New York Supreme Court, Appellate Division, First Department found on June 23 the plaintiff failed to establish that Boies Schiller and Andrew Hayes, a former partner and named defendant, breached their duty of care by representing her despite a conflict of interest.
