California AG Blasts Privacy Law’s Penalties, Deadline

California Attorney General Xavier Becerra (D) is airing concerns that the state’s new privacy law would impose burdensome enforcement obligations and contains a possibly unconstitutional penalty provision.

The law “imposes several unworkable obligations and operational challenges” on the attorney general’s office, Becerra wrote in an Aug. 22 letter to the Democrats who sponsored it, Assemblyman Ed Chau and state Sen. Robert Hertzberg. The law also fails to provide adequate consumer rights to sue and imposes unnecessary reporting requirements for data breach victims, he said.
