Chevron, Progressive Must Answer Oregon Pollution Claims

An older Oregon couple may proceed with hazardous waste cases against Chevron USA Inc. and Progressive Casualty Insurance Co., but not on claims the companies’ conduct constituted financial elder abuse, a federal court in Oregon ruled Jan. 25.

Oregon law creates a cause of action for financial abuse of a “vulnerable person,” including those 65 or older, but doesn’t include the environmental cleanup costs alleged here, the court said.
