The “amount in controversy” required for a defendant to remove a case to federal court based on diversity jurisdiction isn’t limited to damages incurred prior to removal, the U.S. Court of Appeals for the Ninth Circuit held April 20.
The amount in controversy wouldn’t be limited to wages a plaintiff-employee would have earned before removal, for example, the court said in a decision by Judge Jay S. Bybee.
The ruling gave the court jurisdiction to dismiss disability and age discrimination claims against JPMorgan Chase Bank, in an accompanying, unpublished opinion.
