Kellogg Denied Early Exit From Pringles Label Suit

A recent Ninth Circuit decision allowing consumers of flushable wipes to seek label changes after becoming aware of alleged deception continues to gain traction.

A federal trial court in California just applied the wipes decision to allow such claims in a suit alleging Kellogg Co. doesn’t disclose artificial flavors in its Pringles Salt & Vinegar Flavored Potato Crisps.

Plaintiffs’ attorneys say injunctive relief requiring label changes can be more valuable than money damages in consumer suits because they stop the allegedly misleading conduct.
