A New York lawyer who kept representing clients and using his escrow accounts after he was suspended was disbarred without a hearing.
Given the “overwhelming evidence” of Steven S. Herzberg’s noncompliance with the terms of his suspension, the Supreme Court of New York, Appellate Division, First Department said a hearing was “unnecessary” and summarily disbarred him July 26.
While suspended Herzberg continued to hold himself out as a licensed lawyer and to use his escrow accounts, the court said. He also didn’t timely notify his clients, other counsel, or the courts about his suspension.
