Lawyer Suspended After Gamesmanship Tactics Caught on Tape

An Ohio lawyer was indefinitely suspended by the Ohio Supreme Court after ignoring discovery requests and failing to show up for a deposition—tactics he told his client about.

In its Oct. 11 opinion, the court agreed with the Board of Professional Conduct of the Supreme Court. The board concluded that Steven Jerome Moody’s statements to his client explaining his gamesmanship, which the client had secretly recorded, were more credible than his testimony during his disciplinary proceeding claiming inadvertence.

Elton Barrios hired Moody to file an employment discrimination case against Barrios’s former employer, PNC, Inc.
