Ozzfest Producer Waited Too Long to Demand Ozyfest Name Change

A company that produces an annual Ozzy Osbourne-themed concert tour failed to get an injunction to stop a New York festival from using the name “Ozyfest.”

The U.S. District Court for the Southern District of New York ruled that Monowise LC waited too long after finding out about Ozyfest, held in Central Park, to get a preliminary injunction.

The May 3 ruling highlights the importance to trademark owners of acting quickly if they want to stop a rival’s use of an allegedly confusing name.
