SCOTUS Won’t Consider Texas Corporate Officer Liability

A corporate officer failed to convince the U.S. Supreme Court to review a finding that he is personally liable under Texas law for failing to comply with a hazardous waste compliance plan.

The court let stand a Texas Supreme Court ruling that the Texas Water Code applies to individuals as well as businesses.

When an environmental regulation applies to a “person,” a corporate officer faces liability if he personally participated in the wrongful conduct, the Texas high court said.

Under the Water Code, those who do face up to $25,000 per day in civil penalties.
