Supreme Court Strikes Blow to Bristol-Myers Whistleblowers

The Supreme Court declined to hear a false claims case brought against Bristol-Myers Squibb and another pharmaceutical company by two former Bristol-Myers employees.

The court announced May 29 that it would deny two whistleblowers’ petition for a hearing in their False Claims Act suit against Bristol-Myers Squibb and Otsuka America Pharmaceutical Inc. This means the U.S. Court of Appeals for the Sixth Circuit’s decision, which could make it more difficult for whistleblowers to bring cases against pharmaceutical companies, will stand.
