Whistleblowing Worker Deserves (Another) Day in Court: Fed. Cir.

A federal Fish and Wildlife Service worker who says she was fired after reporting alcohol abuse and sex discrimination among her coworkers will get yet another chance to make her case to the administrative board that considers such claims, a federal appeals court ruled Nov. 15.

That’s because the Merit Systems Protection Board abused its discretion when it dismissed Leslie Kerr’s whistleblower claims as untimely and lacking good cause for being so, the U.S. Court of Appeals for the Federal Circuit said in its opinion vacating and remanding Kerr’s case.
