Winston & Strawn Arbitration Case Denied by High Court

The U.S. Supreme declined to take up Winston & Strawn’s attempt to overturn a decision allowing a former partner to sue the firm for gender bias in court, rather than arbitration. The case could have upended a standard used in California for decades to create fairness in the private dispute resolution process that employers believe is onerous.

At issue are guidelines the California Supreme Court created in 2000 outlining rules on minimum due process standards for arbitration, known as the Armendariz standard. The defense bar and employers have long fought the standard.
